Limited liability and indemnity

Limited liability

Where any liability arises through the acts of Bike Stand Company USA or its representatives, and whether or not any loss, damage or injury was caused or contributed to by our negligence, our liability is limited to the fullest extent the law allows and, where a limit is permitted, to the amount you paid for the product.

Bike Stand Company USA and its distributors make no claim that any product is designed to prevent injury or loss. To the fullest extent permitted by law we are not liable to you, or to anyone claiming through you, for any indirect, consequential, incidental or punitive loss.

We are not responsible for shipping or fulfillment delays, the cancellation of a transaction, or the unavailability of a product.

Except in the case of our own wilful misconduct or fraud, you understand and agree that your use of the product is at your own risk.

Indemnity

The person using a Bike Stand Company USA product indemnifies our representatives and distributors against all claims, lawsuits, legal fees and losses arising from that use.

Our products are not directed at, or intended for distribution to or use by, any person or entity in a jurisdiction where that distribution or use would be contrary to law or regulation.

Warranties

Services and content are provided as is and without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the extent the law allows that exclusion. Where we give a written warranty on goods, the federal Magnuson-Moss Warranty Act governs it.

What we do not limit

Nothing on this page limits any liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Some states do not allow the exclusion of certain warranties or of incidental or consequential damages, so parts of this page may not apply to you.
